Please read these terms carefully before using this website or enquiring about an engagement with Estara Ledger. By using this website or submitting an enquiry, you confirm that you have read and understood these terms and that you are at least 18 years of age.
1. Definitions
- "Estara Ledger", "we", "us", "our" — the business operating at 17 Jalan Chung Thye Phin, 30250 Ipoh, Perak, Malaysia.
- "You", "client" — any individual or organisation that uses this website, submits an enquiry, or enters into an engagement agreement with Estara Ledger.
- "Engagement" — a Records Orientation Appointment, Oral History and Provenance Recording, or Institutional Records Practice Consulting arrangement entered into by written agreement.
- "Deliverable" — any output produced in the course of an engagement, including templates, folder sets, audio recordings, transcripts, written assessments, or schedules.
- "Handling Statement" — the document, incorporated into the engagement agreement, specifying what is produced, retained, and destroyed.
- "Website" — the site operated at https://estaraleeds.pro and all pages therein.
2. Acceptance of Terms
By using this website, you agree to these terms. If you do not agree, please do not use this website or submit an enquiry. For engagement-specific terms, a separate written agreement is provided and must be signed before any work begins.
You confirm that you have legal capacity to enter into agreements and are at least 18 years of age. If you are engaging on behalf of an organisation, you confirm that you have authority to bind that organisation.
3. Description of Services
Estara Ledger provides archival, clerical, educational, and organisational services relating to inheritance documentation and family records. Our services are confined to the following three engagements:
- Records Orientation Appointment (RM 480): A two-hour educational session with inventory template, folder set, and professional directory.
- Oral History and Provenance Recording (RM 2,150): Three-session recording engagement producing edited audio, transcript, and provenance notes.
- Institutional Records Practice Consulting (RM 4,650): Business-to-business engagement covering process assessment, taxonomy, training, and six-month review.
Nothing offered here constitutes legal advice, financial advice, valuations, document interpretation, or any regulated professional service. All services are provided as described in the relevant engagement agreement and handling statement.
4. Engagement Process
An engagement begins when both parties have signed a written agreement and handling statement. Submission of an enquiry through this website does not constitute an engagement or any commitment by either party. We will respond to enquiries within five business days.
The scope of each engagement is defined in the written agreement. Any work outside the agreed scope requires a written variation agreed by both parties before the work begins.
5. Payment Terms
- All prices are quoted in Malaysian Ringgit (RM) and are inclusive of applicable taxes unless otherwise stated.
- For the Records Orientation Appointment, full payment is required before the appointment date.
- For Oral History and Provenance Recording, 50% is due upon signing the agreement and 50% upon delivery of the final deliverable.
- For Institutional Records Practice Consulting, payment is due in three equal instalments at dates specified in the engagement agreement.
- Payment may be made by bank transfer to the account details provided in the engagement agreement.
6. Cancellation and Refund
- Records Orientation Appointment: Full refund if cancelled more than 48 hours before the appointment. 50% refund if cancelled within 48 hours. No refund for non-attendance without prior notice.
- Oral History Recording: If cancelled before the first session, any deposit paid is refunded in full. If cancelled after any session has taken place, work completed to that point is charged at a prorated rate and any balance refunded.
- Institutional Consulting: Cancellation terms are specified in the engagement agreement. As a general principle, work completed to the point of cancellation is charged and the remaining balance refunded.
7. Client Responsibilities
- Provide accurate information in enquiry forms and during engagements.
- Confirm that you have the right to share any documents, photographs, or materials brought into an engagement.
- For oral history recordings, confirm that the elder family member has consented to participate in the recording sessions.
- Review any draft deliverables within the timeframe agreed in the engagement.
- Not use this website in any manner that could damage, disable, or impair its operation.
8. Intellectual Property
All content on this website — including text, structure, and design — is owned by Estara Ledger and may not be copied, reproduced, or republished without written permission.
Deliverables produced in the course of an engagement — including templates, transcripts, recordings, and assessments — are owned by the client upon full payment. Estara Ledger retains the right to use anonymised process data (not personal or family data) for internal quality review.
9. Disclaimers
Estara Ledger's services are educational, archival, clerical, and organisational. We do not provide legal advice, financial advice, valuations, or any professional service requiring registration or licensing under Malaysian law. Nothing produced in our engagements constitutes legal documentation.
This website and all content are provided "as is". We make no representations about the accuracy, completeness, or suitability of the information on this site for any particular purpose.
10. Limitation of Liability
To the fullest extent permitted under Malaysian law, Estara Ledger's liability for any claim arising from an engagement is limited to the fee paid for that engagement. We are not liable for indirect, consequential, or incidental losses. We are not liable for the outcome of any legal, financial, or administrative process that a client undertakes following an engagement.
11. Governing Law and Disputes
These terms and any engagement agreement are governed by the laws of Malaysia. Any dispute arising from these terms or from an engagement shall first be addressed by informal discussion between the parties. If unresolved within 30 days, the dispute shall be referred to the courts of Perak Darul Ridzuan, Malaysia, which shall have exclusive jurisdiction.
12. Changes to These Terms
We may update these terms from time to time. The updated version will be posted on this page with a revised "Last Updated" date. Continued use of this website after an update constitutes acceptance of the revised terms. Engagements already in progress are governed by the terms in effect at the date the engagement agreement was signed.
